How Adamawa State Assembly Speaker Lost His Senatorial Ticket

The People’s Democratic Party (PDP) primary election that produced the Speaker of the Adamawa State Assembly, Rt. Hon. Aminu Iya Abbas, as a candidate for the Central Senatorial District, was declared invalid on Monday by the Federal High Court I in Yola, Adamawa State.
The election was declared unlawful on the grounds that candidate Auwal D. Tukur did not renounce his position as Chairman of the Governing Council of the State University of Mubi prior to running.
The poll that led to Iya Abbas being chosen as the flagbearer was thrown out because Auwal Tukur showed up to the event without giving a letter of resignation.
In addition to declaring the exercise illegal, the court also prohibited the party from nominating a candidate for the district in the 2023 general election.
The Adamawa State Assembly speaker, who currently represents the Uba/Gaya constituency in the State House of Assembly, could not run for the district’s seat in the 2023 elections because of the court’s decision.
When ruling on a lawsuit brought by candidate Ibrahim Mustapha (Baba10), the court presided over by Justice A. M. Anka annulled the election.
The judge instead stated that anyone not satisfied with the court’s ruling has the opportunity to appeal the ruling, but rejected the request to order a new primary election.
As learned by theGazetteNGR, the Speaker is thinking about appealing the verdict to seek reparation.
Ibrahim filed a lawsuit against the party, Adamawa State Assembly speaker, Iya Abbas, the chairman of the Governing Council, and Pro-Chancellor of the Adamawa State University (ADSU) Mubi, Auwal D. Tukur, and the Independent National Electoral Commission (INEC), requesting that the election be declared invalid because it was tainted by fraud.
In addition to fabricating or altering the delegate list, he testified before the court that Auwal D. Tukur and several other participants in the activity were government appointees, which was a clear violation of the election act.
Meanwhile, Mohammed Murtala Modibbo’s case was dismissed by the court presided over by Justice Anka on Monday.
In his lawsuit, Modibbo claimed that the speaker gave forged or phony documents to the PDP Screening Committee. He also sought the court to declare the 23 May 2022 election invalid.
Anka gave the case’s ruling, concluding that the lawsuit could not be settled through the originating summons or based on the claims made in the affidavit that was submitted.
According to Justice Anka, the action’s summons-based mode of starting was improper and could not be upheld because the case’s foundation was murky and flimsy.
