Joseph Ayuba Kwada: Michika’s by-election is halted by the court.

Last week’s expulsion from office of an Adamawa State lawmaker, Joseph Ayuba Kwada, representing the Michika Constituency, took on legal significance.
The Adamawa State High Court ruled on Thursday that the Independent National Electoral Commission (INEC) can’t hold elections in the Michika State House of Assembly district.
Following the decision by the Adamawa State House of Assembly to remove Joseph Ayuba Kwada from his seat in Michika, a court ruled that INEC could not hold an election.
Similarly, the court in Yola said that the State Accountant General could not stop Ayuba Kwada from getting his salary, benefits, and other privileges until the appeal was heard.
It was Justice Nathan Musa of the state who said that the court couldn’t rule on the legality of Kwada’s seat being vacant at this time.
Last Monday, the Adamawa State House of Assembly voted to get rid of Kwada and make his job vacant.
Kwada’s defection from the Peoples Democratic Party (PDP) led to his election to the All Progressives Congress (APC) (APC).
If the court rules in Kwada’s favor, he wants to make sure everything goes back to normal.
Kwada asked the court to keep the situation the same as it was before the plaintiff/seat applicant’s was “illegally” proclaimed empty while the court tries to figure out what Section 109 of Nigeria’s Constitution says.
One of Kwada’s complaints was that the State Assembly, its Speaker, the Commissioner of the Ministry of Finance, and so on were all 1st to 6th defendants in the case. He wanted four court orders.
The hearing of the originating procedure will be held on May 16, 2022. This will stop any by-elections to fill Kwada’s seat and stop anyone from trying to take away Kwada’s benefits.
Recall that that Youths gathered in front of the house last week to protest the removal of Kwada but seemed ineffective as the house continued with it’s process the next day.
